Credit Card Service Agreement

The following is your Credit Card Service Agreement with MUSEUM OF CONTEMPORARY ART LIMITED – ABN: 15 003 765 517. The agreement is designed to explain what your obligations are when undertaking a Credit Card recurring payment arrangement with us. It also details what our obligations are to you as your Credit Card payees.

Definitions

• account means the account held at your financial institution from which we are authorised to arrange for funds to be debited.

• Agreement means this Credit Card Service Agreement between you and us.

• Business day means a day other than a Saturday or a Sunday or a public holiday listed throughout Australia.

• Credit card means the credit card details provided by you and the credit card supplied by your credit card provider from which we are authorised to arrange for funds to be charged.

• Credit card payment means a particular transaction where a payment is made.

• Credit Card Request means the Credit Card Request between us and you which takes place when your credit card details are requested for payment. By providing these details for payment you have agreed to the Credit Card Request.

• Credit Card provider means the organisation providing the credit card.

• Payment day means the day the charge will be made on your credit card.

• Us or we means Museum of Contemporary Art Australia (the Payment Recipient) who you have authorised by completing a CCR.

• You the customer who agreed to the Credit Card Request.

• Your financial institution means the financial institution nominated by you within the CCR, via your payment.

1. Debiting your account

By completing a Credit Card Request, you have authorised us to arrange for funds to be charged to your Credit Card. You should refer to this agreement and your membership agreement for the terms of the arrangement between us and you.

We will only arrange for funds to be charged to your Credit Card as authorised in your membership agreement.

If the payment day falls on a day that is not a business day, we may charge your Credit Card on the following business day.

2. Amendments by us

We may vary any details of this agreement or a Credit Card Request at any time by giving you at least fourteen (14) days’ written notice.

3. Amendments by you

You are bound by the details of your membership agreement in regard to the cancellation of payments. To defer a credit card payment or amend your credit card details you must provide us with at least thirty (30) days’ notification by writing to: mcanext@mca.com.au or by telephoning us on (02) 9245-2404 during business hours.

4. Your obligations

It is your responsibility to ensure that there is sufficient credit available on your Credit Card to allow a payment to be made in accordance with your membership agreement and the Credit Card Request.

If there are insufficient credit in your Credit Card account to meet a payment:

(a) you may be charged a fee and/or interest by your Credit Card provider;

(b) you may also incur fees or charges imposed or incurred by us; and

(c) you must arrange for the payment to be made by another method or arrange for sufficient clear credit to be available on your Credit Card by an agreed time so that we can process the payment.

You should check your account statement to verify that the amounts charged to your account are correct and contact us if you have a new expiry date on your card.

5. Dispute

If you believe that there has been an error in charging your credit card, you should notify us directly on (02) 9245-2404 and confirm that notice in writing with us at mcanext@mca.com.au as soon as possible so that we can resolve your promptly. Alternatively, you can raise a dispute with your Credit Card Provider directly.

If we conclude as a result of our investigations that your account has been incorrectly charged, we will respond to your query and notify you in writing of the amount by which your credit card account has been adjusted.

If we conclude as a result of our investigations that your account has not been incorrectly charged, we will respond to your query by providing you with reasons and any evidence for this finding in writing.

6. Confidentiality

We will keep any information (including your account details) in your Credit Card Request confidential. We will make reasonable efforts to keep any such information that we have about you secure and to ensure that any of our employees or agents who have access to information about you do not make any unauthorised use, modification, reproduction or disclosure of that information.

We will only disclose information that we have about you:

(a) to the extent specifically required by law; or

(b) for the purposes of this agreement (including disclosing information in connection with any query or claim).

7. Notice

If you wish to notify us in writing about anything relating to this agreement, you should write to: PO Box R1286, ROYAL EXCHANGE NSW 1223

We will notify you by sending a notice in the ordinary post to the address you have provided to us through your membership signup.

Any notice will be deemed to have been received on the third banking day after posting.

MCA Next Membership Agreement

Paying for your MCA Next membership

MCA Next membership must be paid for in advance. All fees and schedules are subject to change without notice. At the present time, the MCA Next Program requests an annual membership fee of $400 per person and we request an additional, voluntary tax-deductible donation of $400. By becoming an MCA Next member, you are committing to a payment of both amounts, totalling $800, and to a 12-month minimum membership period.

When you join or renew you can opt to pay your membership dues in full or as bi-annual instalment payments. If paying in full, you will be issued a tax receipt noting taxable and tax-deductible portions of your full payment at the time of payment. If paying in instalments, you will be issued a tax receipt noting taxable and tax-deductible portions of your instalment payment at the time of each payment.

Your payment plan fee is deducted from your nominated credit card.

Bi-annual payment plan

How bi-annual payments work:

Payment 1 ($400) will be processed when you join or renew.

Payment 2 ($400) will be processed 6 months after payment 1. This payment will be charged to your nominated credit card. If the payment falls on a weekend, it will be charged on the next working day.

By choosing the bi-annual payment plan, you authorise the MCA to complete the payments as directed above.

Terms and conditions

Insufficient funds in account

Your financial institution may choose to dishonour the request if funds aren’t available in your nominated credit account. If this occurs, the MCA will contact you to settle the payment. It is suggested you contact your financial institution for a list of fees for your account, as each can be different.

Cancelling your membership

You are bound to a 12-month membership. There are no refunds for membership fees; the MCA will not prorate a cancelled membership and the MCA will continue to process any outstanding payments. Your membership will remain active, unless you request to end your membership in writing by contacting the Philanthropy team at mcanext@mca.com.au. To cancel your membership, 30 days’ notice is required. Once your membership has been cancelled, we will send you confirmation of cancellation via email.

Once you reach the 12-month point of your membership, the MCA will contact you to ask for renewal for another 12 months.
